Lack of Updated Safety Management System Contributes to WHS Prosecution

A recent conviction of a Transport Director under Workplace Health & Safety (WHS) laws provides an insight into the approach most likely to be applied under CoR laws, which were aligned to WHS laws in 2018. A lack of an updated Safety Management System (SMS) was a contributing factor in the prosecution. The Transport Director was convicted and fined after a worker was fatally injured from cleaning a coal haulage trailer. The company’s SMS was not updated to reflect the legislative changes and an External audit they carried out  in 2010 was not kept on record.
